TERMS & CONDITIONS: Device Accidental Protection
1. Insurance Company Name –
Insurer – TATA AIG General Insurance Company Limited
2. Definitions –
Insured Equipment – New Mobile Handset / Tablets (Mobile Device)
Sum Insured – Cost of equipment only as per the purchase invoice including GST
Beneficiary –
Purchaser of the mobile device as per the purchase invoice. However, beneficiary of the mobile device can be direct family members viz. his/ her spouse, children or parents.
If the purchaser is a “Company”, beneficiary shall mean any representative / employee of the company authorized to use the mobile device.
3. Scope of Cover –
The insured must have purchased the handset from the empanelled distributer/retailer/dealer of the said manufacturer. The following risk coverage will be provided:
Suffer damage to the exterior or interior component as a result of external impact & such damage cause equipment to stop working.
Fails to work because fluid has managed to enter its internal circuitry.
Fire lighting explosion.
Act of god perils.
Damage during riot, strike & malicious damage.
Insured will not be eligible for any compensation under Mobile Protection Plan for any loss or damage to accessories alone even if forming a part of standard pack or to any complimentary or ancillary product/s, made available under any promotional scheme at the time of purchase.
4. Conditions –
a. Geographical Limit – India
b. Policy is not transferable. The cover shall cease on transfer of ownership of the insured equipment by the Insured to any other party.
c. Policy must be bought within 15 Days from the date of device sale.
d. In case of Accidental Damage, notify Service Provider within 48 hours from the time damage has taken place.
e. The request for change in IMEI No. / Serial No. should be intimated to the insurer not later than 15 days after replacement in case of DOA / Swap.
f. Any correction (Spelling mistake) in policy holder’s name should be intimated within 7 days from the date of policy sale supported with a valid identity proof.
g. Take all reasonable steps to safeguard the insured equipment.
h. In an event of a loss, all benefits shall be forfeited, where there is any misrepresentations, mis-description or non-disclosure of any material fact significant to admission of liability and assessment of loss.
i. In the event of loss, declare/disclose all the material fact about the incidence or event and submit salvage.
j. Insured equipment is purchased along with insured product/services and registered at the time of purchase.
k. Protect the Insured Equipment, as far as reasonably possible, against damage and contact with fluids.
l. Not to modify or alter the Insured Equipment in any way (other than installation of approved software), nor have installed components in the Insured Equipment or have it serviced or repaired by any person not approved by the manufacturer and/or the Insurer.
m. Total liability during the tenure of protection plan will be cost of equipment only as per the purchase invoice including GST.
5. Compensation –
Total liability during the tenure of Protection Plan will not exceed cost of equipment as per the Purchase invoice including GST.
Excess Fee – NIL for all Partial and Total Loss claims
Maximum 2 claims are permissible during the tenure of Protection Plan
Claim settlement in case of Total Loss will be done by like to like replacement device having the same aging of the insured device at the time of claim intimation.
6. Depreciation –
There will be no depreciation applicable
Exclusions:
The Insurance policy does not cover -
1. Damage caused by any process of cleaning, dyeing or bleaching, restoring, servicing, preventative maintenance, repairing or renovation or deterioration arising from wear and tear, moth, vermin, insects or mildew or any other gradually operating cause.
2. Breakage, cracking or scratching of crockery, glass, cameras, binoculars, lenses, sculptures, curious, pictures, musical instruments, sports gear and similar articles of brittle or fragile nature, unless specifically declared and accepted by us and expressly stated in the policy schedule.
3. Loss or damage caused by mechanical or electrical derangement/breakdown of any article unless caused by accidental external means or specifically declared and accepted by us and expressly stated in the policy schedule.
4. Overwinding, denting or internal damage of watches and clocks.
5. Loss or damage to money, securities, manuscripts, deeds, bonds, bills of exchange, promissory notes, stock or share certificates, stamps, travel tickets, travellers’ cheques, business books or documents unless specifically declared and accepted by us and expressly stated in the policy schedule.
6. Any loss or damage arising through delay, detention or confiscation by Customs or other authorities.
7. Loss or damage whether direct or indirect arising from War, Warlike operations, Act of Foreign Enemy, Hostilities (whether war be declared or not), Civil war, rebellion, Insurrection, Civil Commotion, Military or Usurped Power, Seizure, Capture, confiscation, Arrests Restraints and Detainment by the order of any Government or any other authority.
8. Terrorism: This Policy excludes loss, damage, cost or expense of whatsoever nature directly or indirectly caused by, resulting from or in connection with any act of terrorism regardless of any other cause or event contributing concurrently or in any other sequence to the loss.
For the purpose of this exclusion, an act of terrorism means an act or series of acts, including but not limited to the use of force or violence and/or the threat thereof, of any person or group(s) of persons, whether acting alone or on behalf of or in connection with any organisation(s) or government(s), or unlawful associations, recognized under Unlawful Activities (Prevention) Amendment Act, 2008 or any other related and applicable national or state legislation formulated to combat unlawful and terrorist activities in the nation for the time being in force, committed for political, religious, ideological or similar purposes including the intention to influence any government and/or to put the public or any section of the public in fear for such purposes.
This exclusion also includes loss, damage, cost or expense of whatsoever nature directly or indirectly caused by, resulting from or in connection with any action taken in controlling, preventing, suppressing or in any way relating to the above.
9. (a) Any loss, destruction or damage to any property whatsoever or any loss or expense whatsoever, resulting or arising there from or any consequential loss and any legal liability of whatsoever nature, directly or indirectly caused by or contributed to by or arising from ionizing, radiation or contamination by radioactivity from any source whatsoever.
(b) Any loss, destruction, damage or legal liability directly or indirectly caused by or contributed to by or arising from Nuclear Weapons Material.
10. Loss damage or consequential loss directly or indirectly caused by, consisting of, or arising from:
(a) any functioning or malfunctioning of the internet or similar facility, or of any intranet or private network or similar facility,
(b) any corruption, destruction, distortion, erasure or other loss or damage to data, software, or and kind of programming or instruction set,
(c) loss of use or functionality whether partial or entire of data, coding, program, software, any computer or computer system or other device dependent upon any microchip or embedded logic, and any ensuing liability or failure of the Insured to conduct business.
This shall not exclude subsequent damage not otherwise excluded which itself results from an insured peril.
11. Consequential loss or legal liability of any kind.
12. Damage due to or contributed to by the Insured having caused or suffered anything to be done whereby the risks hereby insured against were unnecessarily increased.
13. Damage due to misuse, reckless, abusive, willful or intentional conduct associated with handling and use of the covered item.
14. Any cosmetic damage including but not limited to scratches and dents that do not otherwise affect the functionality of the covered item.
15. Loss or damage arising out of any pre-existing conditions.
16. Loss or damage arising out of the misuse of or use other than in accordance with manufacturer’srecommendation of, or use of any accessory which has not been approved by the manufacturer with the insured appliances
17. Loss arising after 12 months from date of purchase.
CLAIM PROCEDURE –
Damage Category:
The event need to be notified to WIDE within 48 working hours from the time of incident who shall provide claim support by getting the relevant digital claim form documents from the customers, obtain estimate towards damage with proximate cause or reason of damage specifically mentioned in the report, organize pick-up of the damage device from customer, get decision on damage repair expenses from insurer through EIBL, take the damage device to nearest authorized service center post receiving initial decision from insurer, get the damage device repaired and deliver the repair device to the customer.
JIO members shall not get the damaged insured equipment repaired unless intimated to WIDE /EIBL and authorized by insurer.
FRAUD –
If any claim under this policy shall in any respect is found to be fraudulent or if any fraudulent means or devices are used by the Beneficiary/User or any one acting on their behalf, to obtain any benefit under this policy, all benefits and rights of the Beneficiary/User under this Policy shall cease and stand forfeited.

DISPUTES:
Any and all disputes relating to this Protection Plan shall be subject to exclusive jurisdiction of courts in Mumbai only.
