TERMS & CONDITIONS FOR VALUE ADDED SERVICES (FLEXI PAY)

Transwarranty Finance Ltd is a non-banking finance company registered with Reserve Bank of India, incorporated under the Companies Act, 1956, and now existing under the Companies Act, 2013 having its registered office at 403, Regent Chambers, Nariman Point, Mumbai 400021 (hereinafter referred to as ‘TFL’ / ‘Lender’).

WideCare Private Limited is company incorporated under the provision of the Companies Act, 1956,and now existing under the Companies Act, 2013having its Corporate Office at Hub Town Viva, 1101, 11th Floor, Western Express Highway, Jogeshwari East, Mumbai 400060 (hereinafter referred to as ‘WCL’) and is engaged in the business of providing various protection services including device protection cover for accidental, screen, liquid damage and others, warranty services and annual maintenance services.

This document lays out the terms and conditions which shall be applicable to the package of value added services like extended warranty, damage protection plans and annual maintenance services provided by WCL that you (‘the Borrower’) have applied for in the Loan Application Form and financed by ‘TFL’named as FLEXI PAY. By applying, using, availing, or opting for this package, you agree to be bound by these terms and conditions (FLEXI PAY Terms) as mentioned herein as well as the registered General Terms and Conditions for obtaining Personal Loans from ‘TFL’.

‘TFL’and‘WCL’ have entered into an agreement which stipulates TFL can fund extended warranty, damage protection plans, and other products offered by WCL, in the form of loans to customers willing to purchase said products.

GENERAL CONDITIONS APPLICABLE TO SERVICES UNDER FLEXI PAY
- TFL is a facilitator that allows you/ the Borrower to avail and use various options/ services as described herein. For obtaining this package, you have to apply for the same in Loan Application along with your POS Loan/ Personal Loan requirement. The options under FLEXI PAY shall be applicable only with respect to the Loan applied in same application form used for applying FLEXI PAY for use in the manner mentioned below until the termination of the loan period mentioned in Loan Summary and not for any existing or future loan availed either from TFL or any other financial institution/ bank.
- TFL shall disburse the loan amount to WCL on behalf of borrower value added services package purchase and also enter into separate Loan Agreement with borrower post loan disbursement.TFL loans comes with a fixed interest rate, which means borrower’s EMI will remain the same throughout the tenure of your loan. Borrower shall repay the Loan, and the interest payable thereon, in monthly instalments as per the repayment schedule referred to as “EMI” or “Equated monthly instalments”.FLEXI PAY shall be payable irrespective of the fact that you have not utilised any or all services/ options under this package. Services/ options under FLEXI PAY are neither transferrable nor negotiable. Any addition of new options/ services in this package by TFL shall not be available to you.
- For exercising any of the option/ service except plans, you have to raise a request with TFL either by calling at XXX-XXX-XXXXor mailing at xxxxxxx@transwarranty.in. The request must be raised from your registered mobile number or e-mail address registered with TFL. No other mode of request shall be accepted. The request for exercising this option/ service must be raised at least 15 (fifteen) days before the Due Date of the month for which such option/ service is exercised. If the request is made within 15 days of the Due Date or anytime thereafter, such request may be activated for the immediate following month to the extent possible and subject to other conditions of FLEXI PAY.
- 1.4. One or more services/ options in FLEXI PAY may be provided by other service providers independent of TFL. TFL may authorize WCL or any other service providers to facilitate collection of monthly repayment of EMIsfrom borrowers through channels they find suitable.Further, TFL may be required to share your personal details with such service providers in order to provide you necessary services. By applying to FLEXI PAY, you agree to abide by the terms and conditions of such service providers as amended from time to time and grant your consent to TFL to share your personal details with such service providers. Should you have any issue or concern arising from the services/ options provided by such service providers, you agree to raise such disputes/ concerns directly to such service provider and will not make TFL responsible for any deficiency or breach whatsoever.
- Cancellation: In case you wish to cancel the entire loan FLEXI PAY, you may do so by requesting the cancellation during the free look period of 07 days.
SPECIFIC CONDITIONS FOR ‘PAYMENT DEFAULT’ OPTION
- In the event of default of EMI payment, TFL will provide further grace period of 10 days to regularize the payment. In case of no payments beyond 10 days grace period TFL will cancel the entire FLEXI PAY loan and consider the Value Added Services package to be null and void starting from the day after the final day of the stipulated repayment grace period. Further, the benefits of the package of value added services shall be ceased from the date of cancellation. The benefits of the Value Added Services package shall be active proportionate to down payment and EMI paid amount paid by borrower till date. Any amount previously paid towards FLEXI PAY shall not be refunded. Value Added Services Certificate will be amended with revised Start and End Date proportionate to the amounts paid by borrower till date of cancellation.
SPECIFIC CONDITIONS FOR ‘EARLY REPAYMENT’ OPTION .
- You may avail this option any time during Loan Period. Once this option is requested, TFL representative shall communicate you the net amount payable for early repayment of the entire outstanding loan amount. Part-prepayment of loan amount is not allowed.You shall not be charged any penalty on account of prepayment of the Loan. Theborrower may repay at any point of time, the entire outstanding EMIs of the loan by paying the balance EMIs in full. FLEXI PAY shall be removed from the subsequent month’s Monthly Instalment.

I hereby confirm that I have read and understood clearly and completely the provisions of the aforementioned terms and conditions and I undertake to abide by the same. I confirm that I have received the copy of these terms and conditions.

Zero Depreciation

1. Definitions –
Insured Equipment – New Mobile Handset / Tablets (Mobile Device) / Portable Device legally imported in India, purchased through an official channel supported by a valid proof of purchase.
Sum Insured – Cost of equipment only as per the purchase invoice including GST
Beneficiary – Purchaser of the mobile device as per the purchase invoice. However, beneficiary of the mobile device can be direct family members viz. his/ her spouse, children or parents.
If the purchaser is a “Company”, beneficiary shall mean any representative / employee of the company authorized to use the mobile device.
2. Cover –
Accidental Damage and Liquid Damage, subject to Terms and Conditions, definitions and Exclusions as mentioned in Policy Certificate.
3. Conditions –
a. Geographical Limit – India
b. Policy is not transferable.
c. Policy must be bought within 30 Days from the date of new device sale.
d. In case of Accidental Damage, notify Service Provider within 48 hours from the time damage has taken place.
e. The request for change in IMEI No. / Serial No. should be intimated to the insurer not later than 30 days after replacement in case of DOA / Swap.
f. Any correction (Spelling mistake) in policy holder’s name should be intimated within 7 days from the date of policy sale supported with a valid identity proof.
g. Policy issued on a reinstatement basis.
h. Claim settlement in case of Total Loss will be done by replacement / like to like device.

5. Excess – 2.5% of Claim Value, Minimum Rs.500/- for every claim for total loss cases.
6. Total Loss – On Total Loss, Like to Like mobile devices would be provided.
7. Partial Loss - Maximum liability shall be cost of repair and / or replacement, subject to policy excess. If the repair cost or maximum liability at the time of loss exceeds the total loss settlement, insurer shall settle the claim on Total Loss basis under BER (Beyond Economic Repair). If the repair value is more than the net claim payable, beneficiary has to bear the difference between repair value and approved amount.
8. Depreciation – There will be No Depreciation applicable.
9. Maximum 2 Claims are permissible during the tenure of protection plan.
10. Total liability during the tenure of protection plan will be cost of equipment only as per the purchase invoice including GST.
11. Period of Risk - Period of Risk shall mean a continuous period of 12 months commencing from the date of purchase of protection plan from WideCare by the first buyer of the product.
12. We provide onsite services for appliances and pick drop facility for digital products during the active plan period. Customers are strictly advised not to take the breakdown unit directly to Authorized Service Centre unless instructed by WideCare personnel. WideCare will not be liable to pay entire repair charges if above instruction is breached as the unit may be tempered in transit and will pay as per their individual repair estimate assessment
